TERMS AND CONDITIONS OF USE
Permission to use this Online Service and the resulting Information Products is conditional upon you, the "End User", agreeing to the Standard Terms and Conditions set out below:

Standard Terms and Conditions

1. Definitions

  • "Cookie" means an electronic file which is placed on your computer automatically to provide a customised online service.
  • "Department" means the State of Queensland as represented by the Department of Resources and any successor department.
  • "Direct Marketing" means one to one marketing using personal details (e.g. name, address, email address or other personal information), normally supported by a database/resource, which uses one or more advertising media to effect a measurable response and/or transaction from a person (including a corporation or organisation) and includes, but is not limited to, telemarketing, bulk email messaging (spam), postal canvassing and list brokering.
  • "End User" means any person to whom the Department supplies Information Products.
  • "Information Product" means an online product or service supplied through real time online access search types.
  • "Intellectual Property Rights" means all copyright, patent application rights, patent rights, design rights, resource rights, database rights, trademark rights (whether registered or unregistered), trade secrets and confidential information, all know-how, and all other rights of intellectual property.
  • "Online Service" means the online service provided by the Department to view annual valuation listings online, lodge property valuation objections online.
  • "Personal Information" means information or an opinion (including information or an opinion forming part of a database), whether true or not and, whether recorded in a material form or not, about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.
  • "Privacy Laws" means any legislation (or mandatory government policy, where applicable) enacted by Federal or State agencies in relation to privacy and includes the Privacy Act 1988 (Cth) and Information Privacy Act 2009 (Qld).

2. Ownership

  • 2.1 The Department is the owner of the Intellectual Property Rights including copyright in, and to, the Information Products or has the right to make the Information Products available.
  • 2.2 The End User acknowledges that they have no rights of ownership in the Information Products and all Intellectual Property Rights including copyright in the Information Products are unaffected by this agreement.
  • 2.3 The Department (or where relevant the copyright holder) retains ownership of the Intellectual Property Rights that it has in each of the Information Products, whether in its original form, or as reformatted or converted onto different media by the End User.

3. Permitted Use

  • 3.1 The End User may use the Information Products for their own personal use or for use in the ordinary course of their business.
  • 3.2 The End User may only use Personal Information which forms part of an Information Product in accordance with the Standard Terms and Conditions.

4. Prohibited Use

  • 4.1 The End User must not use the Information Products for direct marketing or in breach of the Privacy Laws or with the intention of encroaching on a person’s privacy.
  • 4.2 The End User must not on-sell or distribute the Information Products.
  • 4.3 The End User will not produce any products incorporating the Information Products unless the prior written consent of the Department is obtained.

5. End User's Warranties

  • 5.1 The End User warrants that:
    • (a) They are not impersonating any other person or falsely claiming to represent any other person, whether living or dead, real or fictious. The End User is aware of the fact that making false, misleading or deceptive representations as another person or character can amount to a criminal offence and give rise to civil liability;
    • (b) They will not make a contribution to the Online Service that is misleading, deceptive or false;
    • (c) They will not upload attachments that include obscene, offensive or inappropriate language or material;
    • (d) They will not upload any text or material that infringes the intellectual property rights of others or reveals confidential information; and
    • (e) The details provided by the End User through the Online Service are relevant to their online service request.

6. End User's Acknowledgements and Obligations

  • 6.1 The End User acknowledges that in completing an electronic lodgement using the Online Service they agree to recognise the electronic record of the transaction as made by the Online Service. The End User will retain a print-out of all objection lodgements for their records and to provide an audit trail for any investigation activity that may be required by the Department from time-to-time.
  • 6.2 The End User acknowledges that forms to be submitted through the Online Service may request the End User to indicate their acceptance and approvals of the information contained within the forms and provide their agreement to the submission via the use of OK/ACCEPT buttons.
  • 6.3 The End User will print and retain the original version of any forms and attached documents submitted through the Online Service and will provide these documents to the Department upon request.
  • 6.4 The End User acknowledges that the Department intends to rely on any forms and attached documents submitted through the Online Service as if they were received with signature in paper copy form.
  • 6.5 The End User acknowledges that the Department may not allow them to download or view any attachments submitted as part of the online lodgement.

7. Liability and Indemnity

  • 7.1 The End User agrees to accept all responsibility and risks associated with the Information Products.
  • 7.2 The Department makes no representations or warranties in relation to the Information Products and the End User agrees that, to the extent permitted by law, all warranties relating to accuracy, reliability, completeness, currency or suitability for any particular purpose and all liability for any loss, damage or costs (including consequential damage) incurred in any way (including without limitation, liability in negligence) in connection with any use of, or reliance on the Information Products are excluded or limited.
  • 7.3 The End User agrees to continually indemnify the Department (and their officers and employees) from and against any loss, cost, expense, damage and liability of any kind (including consequential damage) arising directly or indirectly from or related to any claim, demand, suit, action or proceeding (including a claim for a breach of a person’s Intellectual Property Rights) where the loss or liability arose out of, or in connection with, the Information Products, and the End User’s use of the Information Products except to the extent of any negligence by the State. This indemnity will be granted irrespective of whether legal proceedings are instituted and the means, manner or nature of any settlement, compromise or determination. The Department may recover a payment from the End User under this indemnity before it makes the payment in respect of which the indemnity is given.

For electronic lodgement of an objection to a site or unimproved statutory land valuation or an application for a deduction for site improvements in accordance with the Land Valuation Act 2010, the Deputy Director General, Lands has approved the Online Valuation Objection Lodgement System Version 1.2, which is available on the Department of Resources website www.resources.qld.gov.au.
